Terms of Service

Rules for using metuno. The service is provided by Webcode, ul. Oleśnicka 17, 50-320 Wrocław, NIP 8431590186, REGON 021693410, Poland.

1. Definitions

Provider
Webcode, ul. Oleśnicka 17, 50-320 Wrocław, NIP 8431590186, REGON 021693410, Poland.
Service
metuno - a web analytics tool available at metuno.com.
Customer
A natural person, legal person or organisational unit that has created an account in the Service.
Site
A website of the Customer on which the metuno measurement script has been installed.
Visitor
A person using the Customer Site whose traffic is measured.
Measurement data
Events collected by the measurement script on the Customer Site.

2. Scope of the service

The Service collects, processes and presents traffic statistics for the Customer Sites. Measurement works without cookies and without storing anything in the Visitor browser.

The Provider does not warrant that the statistics will match those of other analytics tools. The differences follow from a different identification method and are described in the Service documentation and in the help section of the dashboard.

Using the Service requires a web browser with JavaScript enabled and an internet connection. Installing the script requires the ability to edit the source code of the Site.

3. Contract and account

The contract is concluded when an account is created, which requires an email address, a password and acceptance of these terms.

The Customer is responsible for keeping the password confidential and for actions taken using their account. Any suspected unauthorised access must be reported to the Provider without delay.

One account may hold several Sites. The Customer may invite other people and grant them access to selected Sites, and is then responsible for their actions as for their own.

4. Plans and payments

The Service is available on a free plan and on paid plans whose scope and prices are published on the Service website. All prices are stated in euro (EUR).

The free plan requires no payment details and may be used indefinitely within its limits.

Paid plans are charged in advance for the billing period. Non-payment moves the account to the free plan; collected data remains available within the free plan limits.

An upgrade takes effect immediately, a downgrade from the next billing period.

5. Customer obligations

The Customer installs the measurement script only on Sites they own or have the owner permission to use.

  • The Customer informs Visitors about the measurement in their own privacy policy, naming metuno as the tool and the processor.
  • The Customer does not send, in custom events or page addresses, any data that identifies a Visitor - in particular names, email addresses, phone numbers, order numbers tied to a person, or identifiers from their own systems.
  • The Customer does not use the Service to combine Measurement data with data from other sources in order to identify specific individuals.
  • The Customer does not use the Service in a way that threatens its stability, in particular by generating artificial traffic or circumventing plan limits.

6. Data processing

With respect to Measurement data collected on a Site, the Customer is the controller and the Provider is a processor within the meaning of Article 28 GDPR. The scope, purpose and duration of processing and the obligations of both parties are set out in the Privacy Policy, which serves as the data processing agreement.

The Provider processes Measurement data solely to provide the Service, does not sell it, does not disclose it to third parties and does not use it for its own purposes.

The Provider uses subprocessors for hosting and infrastructure. The current list is in the Privacy Policy. The Provider will give advance notice of any change of subprocessor, allowing the Customer to object and terminate the contract.

7. Availability and liability

The Provider makes reasonable efforts to keep the Service running continuously and reserves the right to maintenance windows, giving advance notice where they are planned.

The Service is a traffic measurement tool, not an accounting system, a document archive or the sole storage for business critical data. Measurement data is statistical and indicative in nature.

The Provider makes regular backups of account data, including Site settings, goals and billing information. After a failure, account data is restored from the most recent available backup, and lost changes are limited to the period since that backup was taken. Measurement data, due to its volume, may be lost in whole or in part as a result of a failure and to that extent cannot be restored; this does not constitute improper performance of the Service where the Provider has exercised the care described in this section.

The Provider is not liable for non performance or improper performance of the Service caused by force majeure or events beyond its control, in particular a failure of a data centre, power or telecommunications network, an attack on the infrastructure, or unavailability of third party services.

The Provider is not liable for business decisions taken on the basis of the statistics, nor for data loss caused by the Customer, including deletion of an account or a Site.

Towards a Customer who is not a consumer, the Provider liability is limited to the fees paid by that Customer in the twelve months preceding the event and does not cover lost profits. This limitation does not apply to damage caused intentionally.

Nothing in these terms limits consumer rights arising from mandatory provisions of law.

8. Termination

The Customer may delete their account at any time in the dashboard settings. Deletion is irreversible and covers all Measurement data of all their Sites; event tables are dropped, not archived.

The Provider may terminate the contract with fourteen days notice, or with immediate effect in case of a gross breach of these terms by the Customer, after first calling on them to stop.

Should the Service be discontinued, the Provider will inform Customers at least thirty days in advance and allow them to export their data.

9. Right of withdrawal

A Customer who is a consumer, or an entrepreneur with consumer rights, may withdraw from the contract within fourteen days of concluding it, without giving a reason, by writing to contact@metuno.com.

Starting to use a paid plan before that period ends, at the Customer explicit request, means payment is due for what was provided up to the moment of withdrawal.

10. Complaints

Complaints should be sent to contact@metuno.com, quoting the account email address and describing the problem.

The Provider will consider the complaint within fourteen days of receiving it and reply to the account email address.

11. Changes to these terms

The Provider may amend these terms for important reasons, in particular changes in law, in the scope of the Service or in the way it is provided.

The Customer will be notified at the account email address at least fourteen days before the changes take effect. Continued use after that date means acceptance; a Customer who does not accept may terminate the contract with immediate effect.

12. Final provisions

Matters not covered by these terms are governed by Polish law. This choice of law does not deprive a consumer of the protection of the law of their country of habitual residence.

Disputes with a Customer who is not a consumer are settled by the court competent for the Provider registered office. Consumers may use out-of-court complaint procedures, including the ODR platform at ec.europa.eu/consumers/odr.
